Inverness City Suites (ICS) Terms and Conditions of Booking – Short Stay Bookings

Law: Your booking is governed by Scottish law and is subject to the exclusive jurisdiction of the Scottish Courts. The booking confirmation and these terms and conditions represent the entire agreement between Caledonian Coffee Company Limited trading as Inverness City Suites (ICS) and the client /agent. ICS reserves the right to amend their Booking Terms and Conditions at any time without notification.

Prices: Prices are per apartment, per night, inclusive of Value Added Tax (VAT). Corporate rates may be quoted exclusive of VAT. Limited numbers of apartments may be allocated to individual rates, packages, or promotions, when these allocations are taken up any remaining apartments may be offered to the client at a higher price.

Availability: All rooms and rates offered by ICS are subject to availability at the discretion of the management. ICS reserves the right to refuse any booking, without explanation, and this may include booking made by guests from local postcode areas. ICS will not accept bookings from stag / hen or similar parties. The minimum age for check-in is 21.

Bookings: All bookings made with ICS must be guaranteed by a valid credit or debit card or by payment of a deposit. At the discretion of ICS , or for some of our promotions or packages, full pre-payment may be required. Please Note: By making payment for a booking, or by providing credit / debit card details for a booking you are accepting the following booking terms and conditions.

Commission: Agents commission must be negotiated and agreed in writing prior to booking. ICS reserves the right to refuse commission on agency bookings delivered without prior written agreement on commission.

Booking Amendments: ICS will endeavour to accommodate booking amendments, however, reserves the right to charge for any diminution to the booking. If we are unable to amend a booking and the client/agent subsequently cancels their reservation our standard cancellation terms will apply (see below).

Cancellation or Non-Arrival: for Best Rate Plan bookings, reservations can be cancelled free of charge up to 18.00 hours (UK time), 3 days prior to arrival; after this time 100 % of the full stay cost will be charged for cancellation or non-arrival. Advance Purchase Rate Plan bookings can be cancelled free of charge up to 18.00 (UK time) 30 prior to arrival after which they are non-refundable and non-transferable in the event of cancellation, amendment or in the event of non-arrival.

Payments: Best Rate Plan – full payment is due 3 days prior to arrival. Advance Purchase Rate Plan – full payment is due 30 days in advance of arrival. Payments will be charged to the credit or debit card provided to guarantee the booking unless other payment arrangements have been agreed. If payment
cannot be taken on the card provided ICS reserves the right to cancel the reservation without notice and re-sell the apartment availability.

Credit accounts are only offered further to completion by the client (and formal acceptance by ICS) of an application for credit facilities; this facility may be withdrawn at any time without notification. Credit facilities are not offered to private individuals.

Security Deposit: A pre-authorisation of bookers credit / debit card (temporary hold to the value of £200.00) is required from 3 days prior to arrival to secure funds against potential damage / sundry charges as detailed below. This hold expires after 7 days. A pre-authorisation is not a charge and therefore no funds are debited from your account (unless damage charges are applied) and therefore there is no credit back to your account. Any applicable charges will be communicated to guests at the earliest opportunity on or after the day of departure and a receipted invoice will be forwarded to the registered address of the client/guest. Your booking confirmation will ask you to indicate whether you wish to use the payment card for this or to request a secure PAYLINK to be sent for card details.

Arrival and Departure: Check in time is after 3.00pm on day of arrival. Departure is 11.00am (latest) on day of departure. Early arrivals and late departures may be possible but cannot be guaranteed. We can normally store luggage, by advance request – please contact our office. ICS reserves the right to charge one full night stay for unauthorised late departures.

Damage / Loss: ICS reserves the right to levy a charge to cover the full cost of rectifying damage or loss to ICS property or structure caused by (but not exclusive to) deliberate, negligent or reckless acts, omission, default or neglect by the clients, their guests or visitors. By providing the security deposit the cardholder is providing permission for ICS to charge for any damage or loss, against the funds pre-authorised on the credit/debit card supplied, that come to light during the apartment servicing / inspection after guest departure. This includes the failure to return the key sets provided on arrival. ICS will always make every effort to keep charges to a minimum.
In line with Scottish law, ICS operates a NO SMOKING POLICY throughout the interior of the apartments, corridors and stairwells of the apartment buildings and reserves the right to charge up to £200 for commercial apartment cleaning should tobacco / vape odours or evidence of smoking be found within the apartment/s reserved.

Additional Apartment Cleaning: On departure ICS require apartments to be left in clean and tidy order (as further described in the apartment Guest Directory); ICS reserves the right to charge an apartment cleaning charge if kitchens / apartments are left in an unsatisfactory condition.

Pet Policy: Pets may be accepted at the discretion of the management; additional cleaning / removal of pet hair will be charged at £20.00 per hour. Please contact our office prior to booking for full details of our Pet Policy.

Security / CCTV: please note for your safety and security property entrances are monitored by CCTV cameras.

Apartment Use: this agreement is made under the terms of section 12 (2) and schedule 4 section 8 of the Housing (Scotland) Act 1988 which gives the client/guest the right to occupy the apartment for the agreed period and for holiday/corporate stay purposes only and whereby there will be no security of tenure within the terms of the said act.

The client / guest agrees to use this property solely for the purpose of a private holiday apartment / corporate residence for the maximum of people shown on the booking correspondence, or notified to us prior to arrival, and agrees not to use the property for any improper, illegal, or immoral purposes or to sub-let the property.

Any client / guest or occupant found using the apartment for illegal activities will be required to leave immediately and will forfeit all payments made. No visitors are permitted between 11.00 pm – 7.00 am without written consent of the management. ICS reserves the right to refuse any booking, without explanation. In the event of complaints of disturbance the management reserve the right to terminate your stay with immediate effect and with any payments made being held forfeit.

Statutory Requirements: ICS is subject to statutory controls, including those relating to fire, hygiene and health and safety. These requirements must be strictly adhered to by clients /guests and all apartment occupants.

Discrimination and General Behaviour: It is the policy of ICS not to discriminate on the grounds of race, colour, nationality, creed, sex, marital status, age, ethnic origin or disability. Clients, their employees and guests are expected to adhere to this policy, ICS may, without incurring any liability to the client, remove from the apartments any person or persons not adhering to this condition.

Force Majeure ICS will not be liable for not fulfilling its obligations if failure to do so is caused by conditions beyond its control including and not limited to Acts of God, power failure, famine, war, terrorism, government intervention or any other reasonable act.

Liability: Other than for death or personal injury caused by the negligence of ICS, the apartments liability to the Client is limited to the price of the booking. Unless ICS is liable under the above clause, the Client indemnifies ICS from and against, any and all liability, and any claims, proceedings or damages resulting or arising from the booking, the Client, guests or any outside contractors of the Client. ICS does not accept responsibility whatsoever for damage to, or theft from, or theft of, vehicles parked within the authorised apartments car park.

Third Party Liability ICS does not accept any liability for services rendered by third parties to Clients notwithstanding that such services may be arranged by
ICS. Any claim, demand, charge, suit or damages which may be Incurred by the Clients or their guest (or any person claiming thereunder) shall be made directly with such third parties and ICS shall render all reasonable assistance in this regard.

Insurance: The client is recommended to have and is responsible for insurance to cover cancellation, curtailment, and loss of baggage, personal effects and money. Data Protection The information provided by the Client may be processed by ICS for the purposes it has notified to the Information Commissioner. By confirming a booking or enquiry, the Client consents to this processing of the information. ICS respects the privacy of every individual who visits our website. The data collected about you will be used to firstly fulfil any service you might request, for example, to request a brochure, make a booking etc and secondly to improve how, as a company, we serve you.
We will under no circumstances give your personal data to third parties. However, unless you specifically ask us not to (and this option is always given) we will use your data to send you further information from ICS. Any e-mail sent to you will always provide you with the option to unsubscribe. This is in accordance with UK Data Protection Legislation.
When making a booking, your credit card or billing account details are only retained for the purpose of handling that individual transaction, unless you ask us to keep these details for future purchases which you may make through us. In order to process a booking or enquiry, your personal information and payment details may be passed to third party service providers and, where we are lawfully requested to do so, regulatory authorities. Such third-party service providers will have access to the personal information needed to perform the relevant service. They may not, however, use your personal information for any other purposes and are required to process your personal information in accordance with the Data Protection Act 1998. For your protection we are registered under the Data Protection Act 1998 and have given all appropriate notifications to the Information Commissioner.

The information contained in this website is provided in good faith. The use of any information from this website is entirely at the risk of the user. ICS will not be liable for any costs, losses, expense or damages (whether direct or indirect, special, economic or financial) that may be incurred through the use of any information contained in this website or in any other website linked to this website.
